TERMS AND CONDITIONS AGREEMENT
This Terms of Service Agreement ("Agreement") is entered into between Just Pended Denver ("Company"), located at 3500 Rockmont Dr Suite #01-411, Denver, CO 80202, and the customer ("Customer"), for the provision of Real Estate Photography services.
Services:
Company agrees to provide Real Estate Photography services to Customer as agreed upon in the contract or agreement between the parties.
SMS Service:
Company offers an optional SMS service to keep the Customer updated. By opting in to this service, the Customer agrees to receive SMS messages from the Company. The Customer can cancel the SMS service at any time by simply texting "STOP" to the shortcode provided. Upon sending "STOP," the Company will confirm the Customer's unsubscribe status via SMS. Following this confirmation, the Customer will no longer receive SMS messages from the Company. To rejoin the SMS service, the Customer must sign up as they did initially, and the Company will resume sending SMS messages.
Support:
If the Customer experiences issues with the messaging program, they can reply with the keyword "HELP" for more assistance. Alternatively, the Customer can reach out directly to team@justpendeddenver.co for support.
Payment:
Customer agrees to pay the fees associated with the Real Estate Photography services as outlined in the contract or agreement between the parties.
Ownership of Deliverables:
Upon receipt of full payment, the Customer will own the deliverables provided by the Company, including but not limited to photographs and other media produced during the Real Estate Photography services.
Use of Deliverables:
The Customer may use the deliverables for their own personal or business purposes. The Customer may not sell or license the deliverables to any third party without the written consent of the Company.
Confidentiality:
Both parties agree to keep any confidential information shared during the course of the agreement confidential. This includes, but is not limited to, pricing information, trade secrets, and any other proprietary information.
Limitation of Liability:
The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the provision of Real Estate Photography services.
Governing Law:
This Agreement shall be governed by and interpreted in accordance with the laws of the state of Colorado.
By signing below, the parties acknowledge that they have read, understood, and agree to the terms and conditions of this Agreement.
